XI CHAPTER	
Probation sanctions from the Grand Council, Phi Sigma Kappa

Amended June 14, 2003

The Xi chapter of Phi Sigma Kappa has been placed on probation status effective May 5, 2003 for violations of the Grand Chapter's Risk Management Policies in relation to a social activity held March 6, 2003. Consequently, the following sanctions have been imposed on the chapter (note: the original sanctions were amended on June 14, 2003 by the Grand Council pursuant to a second risk management incident involving the chapter):

1. The chapter's insurance premium for the 2003-2004 academic year shall increase based on the Fraternity's premium allocation program. The chapter must pay its 2003-2004 by the specific due date (October 1, 2003) or face and additional 25% penalty.

2. The Chapter is prohibited from having any alcohol at any and all social events, on- or off-campus, on- or off-chapter property, formal or informal, or at any brother's domicile or resident such that a reasonable person could interpret the function to be that of Phi Sigma Kappa, for a period no sooner than May 31, 2004. Further, they will be prohibited from attending and participating in other fraternities'/sororities/student organizations' social events where alcohol is present during that same time period.

3. All members will be required to sign a form noting that they have read and will comply with the Fraternity's risk management policies, university policies and state law. Failure to sign will result in expulsion. Due date for these documents is September 15, 2003.

4. Since the information provided on the incident shows the chapter officers were derelict in their responsibility to enforce our policies, the Grand Chapter reserves the right, if so deemed necessary, to suspend executive board members from office and new officers must either be selected or elected within ten days.

5. The chapter must host an all-campus workshop on responsible alcohol use and risk management practices. The session facilitator must be pre-approved by the Fraternity's Executive Vice President, and all chapter members required to attend. Failure to attend will result in expulsion. There are no allowable absences for chapter members. The seminar must be held no later than September 30, 2003.

6. All chapter ritual officers and the social chairman will be required to sign a document stating they are aware of and will enforce the Fraternity's risk management policies. Failure to do so will result in their immediate removal from office. This document will be due no later than September 15, 2003.

8. The chapter will be required to send 4 (rather than 3) men to the Fraternity's August, 2003 general convention and leadership school. In addition to the required delegates (president, treasurer, and recruitment chairman), the chapter must also bring its social chairman as the other delegate. There will be no allowance for substitution for any of the required delegates. If the required delegates do not attend as instructed, the chapter's probation and alcohol ban at social functions will continue for at least one more semester.

9. The chapter will be required to send 8 (rather than 6) delegates to its 2004 regional conclave. The same conditions exist for this sanction as outlined in #8.

10. Any violation of these sanctions, or any additional risk management policy violation during the probation, will result in charter suspension.

11. Should the chapter violate the Fraternity's risk management policies within a two year period following the removal from probation, the chapter's charter will be suspended.

In addition to changes above from the original sanctions, the following are additional amended sanctions from June 14, 2003:

12. There is an immediate and permanent alcohol-free policy imposed for the Xi Chapter house. This is defined as an indefinite ban on the consumption of alcohol in or on chapter house premises (with the exception of one alumni association-sponsored party - for alumni brothers only - per year; this function must comply with the Fraternity's risk management policy involving alcohol and third party vendor guidelines).

13. The initiation of procedures, subject to due process and the rules of the Grand Chapter, to discipline all brothers (to include graduating seniors and upperclassmen) who may have been involved with the transgressions that occurred during Senior Week, 2003. These proceedings may result in expulsion from Phi Sigma Kappa or other disciplinary measure, included but not limited to, making restitution to St. Lawrence University for any cost of repair to the chapter house.

14. An Alumni Advisory Council (AAC) shall be immediately instituted in accordance with the proposed guidelines submitted by alumni brothers Julian Modesti, Bob Easterly, Matt Ellis, Alan Osbourne, Josh Carter, Gary Godshaw, Rob Housman.

15. The AAC shall recommend, and the Grand Chapter shall appoint, one or more alumni brothers to serve as the Grand Chapter-appointed chapter adviser/co-advisers, with the understanding that an adviser or at least one co-adviser, shall attend all chapter meetings, or at minimum every other chapter meeting.

16. The AAC will fund, and have in attendance, three (3) AAC members attending the 2003 General Convention.

17. The AAC will conduct oversight activity during the chapter's recruitment process in order to assure the recruitment, retention and initiation of students with compatible values as those ideals of Phi Sigma Kappa.

18. The chapter's g.p.a. must be above the all-men's g.p.a. for all semesters during the terms of probation.

19. The Xi undergraduate chapter president and at least 2 members of the AAC will meet monthly with the St. Lawrence University Greek Adviser.

20. The undergraduate chapter will comply with all Grand Chapter deadlines and requests for information and reports, including but not limited to initiate reporting and payment procedures, monthly accounts receivable billings, change of officers, convention/leadership school/conclave registration, census rosters, etc.).

21. There is a permanent ban on all Senior Week activity at the chapter house, and there shall be no members or non-members of the chapter living in the chapter house during said time unless under employ by S. Lawrence University.

22. The chapter will have weekly reporting meetings with the AAC and a Grand Chapter officer to be designated via e-mail group.

23. The Grand Chapter will review the progress of all sanctions at its mid- year meeting during the 200-2004 year, and again in May of 2004.

While we are clearly not in the business of closing chapters, we would much rather have less chapters who are committed to complying with our policies rather than our over 90 chapters who may be questionable.
